INSURANCE BENEFITS 2006/7
The NAKMAS National Governing Body present the annual licensing and insurance review. Please read the following carefully as it outlines the benefits of the insurance policies in operation via NAKMAS, applicable from 01 SEPTEMBER 2006
All those who take part in sport and recreation, either as administrators, officials, coaches, or participants, have a Duty of Care to ensure that anything they do does not cause injury or financial loss to others or damage to property. If their actions do cause injury, loss or damage and ‘negligence’ can be proven, they become legally liable to pay compensation. Allegations of negligence are increasing at an alarming rate, as is the type and variety. As such it is essential that all those who do take part have the appropriate insurance protection to protect them.
PERSONAL ACCIDENT/MEMBER TO MEMBER
The NAKMAS National Governing Body licence for both instructors and students provides the valuable member to member liability insurance for £10 million pounds, and the following personal accident benefits:
Death (16 years and over) £15,000 Death (under 16 years) £ 2,000 Permanent total disablement from usual employment/occupation Including loss of limb(s) or eye(s) £30,000 (not available for those age 65-84)
The following weekly benefits will be payable for Temporary Total Disablement , after a four week deferment, payable for up to 52 weeks. Instructors £100.00 per week Students (Employed) £ 50.00 per week
We now cover all students with a basic member to member liability cover at £10 million for the first four weeks of training for FREE.
BUDO LICENCE
This licence slip includes NAKMAS membership, registration, and member to member liability at £10 million pounds. The budo licence does not incorporate personal accident insurance. It is therefore only suitable for short courses, eg, self defence; and for an initial period prior to issuing the full licence/insurance. It is not to be issued to instructors. It is not suitable for those students who train continuously in a martial art, as this could lead to serious legal implications for the instructor/club, at a later date.
CIVIL LIABILITY
This is a unique scheme developed to protect everyone (including volunteers) against any legal liability.
Each new affiliation and re-affiliation is now processed with a Civil Liability Policy. This policy is issued to the club/group, in the name of the Chief Instructor, so there is no need to purchase additional club liability cover. All venues and instructors under the control of the named Chief Instructor will be covered for the following:
Public/Products Liability (formerly Club Liability) £10,000,000 This is defined as ‘sudden accidental injury to an individual (third party) or damage to property caused in a single, clearly identifiable, occurrence’.
Employers Liability £10,000,000 (Certificate of Employers Liability issued)
Professional Indemnity £5,000,000 (free to all NAKMAS instructors and assistant instructors holding a current NAKMAS endorsed instructor or assistant instructor NAKMAS licence).
This covers coaches, administrators, officers, officials etc who supply a skill or service against their legal liability to compensate third parties who have sustained injury, loss (financial or otherwise) or damage, due to their professional negligence. This could apply to:
Failure to enforce/apply rules and regulations Disciplinary issues Bias/discrimination Team selection disputes Poor coaching advice Lack of supervision Training of officials, eg referees, judges Professional related negligence, eg drug related issues
LIBEL AND SLANDER
Defamatory statements are those which injure the reputation of others by causing them to be subject to hatred, ridicule, contempt or fear, so that their reputation suffers or that they are prejudiced in other ways.
In sport, this would include not only statements made either verbally or in writing, but also the consequences of allegations of abuse.
DIRECTORS AND OFFICERS
Directors and Officers have certain duties to perform and they can be held accountable for a breach of them. This insurance provides indemnity against the threat of personal litigation.
Other policy features:
World Wide Cover (for the Chief Instructor)
Cover for other instructors where they are working with/for the Chief Instructor at a NAKMAS affiliated club. Indemnity to Principals/leased and rented facilities Member to Member The Policy covers ‘any activity’ of the insured—which has been approved by NAKMAS.
IF YOU HAVE A GROUP WHERE YOU HAVE SEVERAL INSTRUCTORS (EITHER IN THE SAME OR DIFFERENT AREAS) WHO ARE NOT UNDER THE DIRECT CONTROL OF THE CHIEF INSTRUCTOR, EACH WILL NEED TO PURCHASE A CIVIL LIABILITY POLICY.
PROFESSIONAL INDEMNITY
If any instructors, other than the Chief Instructor, wishes to purchase separate professional indemnity cover this can still be done. As usual this is covered at £5 million. This will be useful if any instructors other than the Chief Instructor need World Wide Cover.
